Deux passages de ce supplément sont enchâssés dans la discussion: Les adieux du vieillard, et le long Entretien de l'aumônier et d'Orou.

The article that follows is the second part of a study on Freedom prepared by the author for the International Dictionary of the Basic Terms of Philosophy and political Thought. The first half of the essay appeared in Philosophy Today, Summer 1960, pp. 126-136.

Les conflits sont consubstantiels à l’homme. Pour les régler, recourir à la justice plutôt qu’à la force permet la vie en société. Cependant, la justice étatique, rendue dans de nombreux pays par des juges non indépendants du pouvoir exécutif, est parfois erratique ou partiale, rarement réparatrice et souvent chère et lente. Comme alternative, existent des modes dits alternatifs comprenant les modes amiables (non juridictionnels) et l’arbitrage (mode quasi-juridictionnel), qui peuvent être utilisés séparément, successivement ou en parallèle. Y recourir en dépassant (...) certaines réticences permet d’éviter bien des défauts de la justice étatique, en particulier en raison de l’acceptation par les parties de la solution amiable trouvée. Ces modes alternatifs sont pratiqués le plus souvent par des avocats et ont de plus en plus la faveur des politiques publiques, tant en France qu’à l’étranger. (shrink)

Tâche difficile, non pas tant parce que la mentalité américaine serait plus qu'une autre réfractaire à cette pensée—on pourrait faire remarquer en effet l'influence exercée très tôt sur la formation et l'évolution de la pensée marcellienne par J. Royce—mais en raison de la nature toute particulière de la manière m≖me dont Marcel philosophe.

To fulfill their crucial duty of relieving suffering in their patients, physicians may have to administer palliative sedation when they implement treatment-limitation decisions such as the withdrawal of life-supporting interventions in patients with poor prognosis chronic severe brain injury. The issue of palliative sedation deserves particular attention in adults with serious brain injuries and in neonates with severe and irreversible brain lesions, who are unable to express pain or to state their wishes. In France, treatment limitation decisions for these patients (...) are left to the physicians. Treatment-limitation decisions are made collegially, based on the presence of irreversible brain lesions responsible for chronic severe disorders of consciousness. Before these decisions are implemented, they are communicated to the relatives. Because the presence and severity of pain cannot be assessed in these patients, palliative analgesia and/or sedation should be administered. However, palliative sedation is a complex strategy that requires safeguards to prevent a drift toward hastening death or performing covert euthanasia. In addition to the law on patients' rights at the end of life passed in France on April 22, 2005, a recent revision of Article 37 of the French code of medical ethics both acknowledges that treatment-limitation decisions and palliative sedation may be required in patients with severe brain injuries and provides legal and ethical safeguards against a shift towards euthanasia. This legislation may hold value as a model for other countries where euthanasia is illegal and for countries such as Belgium and Netherlands where euthanasia is legal but not allowed in patients incapable of asking for euthanasia but in whom a treatment limitation decision has been made. On le sait, l'oeuvre de Jean Ladrière se déploie, avec génie et originalité, dans bien des domaines: la physique, les mathématiques, la logique, les sciences du langage, la philosophie et la théologie. Les textes réunis dans ce volume tentent de penser les «articulations du sens» de cette notion de «limite», en prenant (...) la mesure des questionnements les plus contemporains, que ceux-ci émanent de perspectives scientiques, politiques, éthiques ou encore pratiques. Uncertainty about the acceptability of the forest industry and its practices to the citizens of Mississippi provided the impetus for a study of the attitudes and perceptions of eight constituency groups toward the forest industry in the state. This study examines attitudes and perceptions of two of those groups, loggers and two environmentalists/conservationists, and finds similarities and differences. Survey data analysis finds that all groups hold similar perceptions of themes defining the forest industry and forest industry occupations but differ concerning (...) activities the industry does or does not perform well and environmental problems associated with the forest industry. Mississippi Loggers Association members hold more positive attitudes/perceptions, similar to those of the Mississippi Wildlife Federation. Attitudes/perceptions of Mississippi 2020, a small grassroots organization, differ from Mississippi Loggers Association members in all instances and from Mississippi Wildlife Federation members on some issues. This study investigates potential differences in attitudes towards corporate social responsibility between Saudis and Muslims from other predominately Islamic countries. We propose that Saudi Arabia’s unique rentier-state welfare and higher education systems account for these distinctions. In evaluating our propositions, we replicate Brammer et al. :229–243, 2007) survey on attitudes towards CSR using a sample of Saudi undergraduate and graduate business students and compare the results against data from subjects in other majority Muslim countries. In addition, this work examines possible (...) differences within the Saudi sample with respect to sex and academic level. Our results indicate that our Saudi subjects maintain higher expectations for corporations’ social responsibility within their supply chain than the Brammer et al.’s sample. In contrast, Muslims in the Brammer et al.’s sample hold higher expectations for corporations in supporting societal development and poverty alleviation in comparison to the Saudi sample. We also find within the Saudi sample that females and subjects at higher academic levels are more inclined to hold corporations responsible for social issues related to CSR than males and subjects in lower academic levels. We examine these findings, explore their implications, and propose areas for future research. (shrink)

Functional diversity holds the promise of understanding ecosystems in ways unattainable by taxonomic diversity studies. Underlying this promise is the intuition that investigating the diversity of what organisms actually do—i.e. their functional traits—within ecosystems will generate more reliable insights into the ways these ecosystems behave, compared to considering only species diversity. But this promise also rests on several conceptual and methodological—i.e. epistemic—assumptions that cut across various theories and domains of ecology. These assumptions should be clearly addressed, notably for the sake (...) of an effective comparison and integration across domains, and for assessing whether or not to use functional diversity approaches for developing ecological management strategies. The objective of this contribution is to identify and critically analyze the most salient of these assumptions. To this aim, we provide an “epistemic roadmap” that pinpoints these assumptions along a set of historical, conceptual, empirical, theoretical, and normative dimensions. (shrink)

Researchers from diverse disciplines, including organismal and cellular physiology, sports science, human nutrition, evolution and ecology, have sought to understand the causes and consequences of the surprising variation in metabolic rate found among and within individual animals of the same species. Research in this area has been hampered by differences in approach, terminology and methodology, and the context in which measurements are made. Recent advances provide important opportunities to identify and address the key questions in the field. By bringing together (...) researchers from different areas of biology and biomedicine, we describe and evaluate these developments and the insights they could yield, highlighting the need for more standardisation across disciplines. We conclude with a list of important questions that can now be addressed by developing a common conceptual and methodological toolkit for studies on metabolic variation in animals. (shrink)
